AlvaradoSmith Defeats $14 Million Suit with Complete Employer Defense Verdict

AlvaradoSmith attorneys Ted Bacon and Joanne Chan won a resounding victory in defense of an aircraft parts manufacturer against two former employees for alleged wrongful termination seeking millions of dollars in damages. The plaintiffs asserted numerous claims against our client, including whistleblower retaliation, wrongful discharge, disability discrimination, disability harassment, defamation, and PAGA claims.

Before trial, the plaintiffsโ€™ settlement demand was $11.5 million, but by the time the case went to trial, their attorney asked the jury for $14 million in damages. The trial was held in the Central District of Los Angeles Superior Courtโ€”a venue not generally considered favorable to employers or corporations. While the facts presented by Plaintiff were very unfavorable to our client, the trial plan executed by Ted and Joanne focused a compelling narrative that attacked the credibility of the plaintiffs and undermined their claims. Ted and Joanne armed the jurors with clear, consistent, and relatable evidence throughout the trial and closing arguments, and that carried the day.

After five years of litigation and a three-week jury trial, the jury deliberated less than an hour and a half before returning a defense verdict on all claims. Ted and Joanne demonstrated what we at AlvaradoSmith pride ourselves on providing for our clients: thoughtful planning, skilled litigating, and favorable outcomes.

Ted Bacon and Joanne Chan have successfully helped clients resolve a wide variety of disputes, including all types of employment and business related matters like discrimination claims, wage and hour class actions, trade secrets and unfair competition claims, unfair business practices, and breach of contracts disputes. Tedโ€™s experience as a seasoned trial lawyer has given him the ability to advise clients on what they need to know and do to minimize exposure to claims, and to maximize the chances for positive results if suits are filed.
