The Daily Journal, California’s leading legal newspaper, published an article by Marc D. Alexander entitled, “Opening the Federal Courthouse door to takings claims.”. This article examines the recent SCOTUS case, Knick v. Township of Scott, holding that a 5th Amendment Takings Clause claim may be brought in federal court under 42 U.S.C. section 1983 at the time of the taking, without having to wait for a denial of just compensation in state court.
